Terms of Service

Introduction

Welcome to Onze Retreats! Danby & Sons, operating as Onze Retreats, provides unique property rental experiences in Mexico for vacations, retreats, weddings, and events. By accessing or using our services through our website, you agree to be bound by the following terms and conditions. Please read them carefully.

Booking and Payment

Reservations

• —Vacations: A 50% deposit is required at the time of booking.
• —Retreats: A 30% non-refundable deposit is required at the time of booking.
• —Weddings & Events: A 50% deposit is required at the time of booking.

Payment Schedule

• —Vacations: Remaining 50% is due 60 days before the reservation date.
• —Retreats: 50% of the total cost is due 60 days before the reservation date. The remaining 20% is due 7 days before.
• —Weddings & Events: Remaining 50% is due 60 days before the reservation date.

Payment Methods

Payments must be made in Mexican Pesos via bank transfer or through provided payment links. All additional payment fees are the responsibility of the Client. Payments by credit card incur a 5% service fee.

Cooling-Off Period

For retreats, a 7-day cooling-off period is provided from the date of booking, during which the reservation may be canceled and a full refund issued. After this period, the deposit becomes non-refundable.

Cancellation Policy

General Terms

Cancellations made within 7 days of booking receive a full refund, including any non-refundable deposits.

Specific Terms

For cancellations made less than 60 days before the reservation date, no refunds will be issued.

Force Majeure

In the event that your booking is affected by circumstances beyond our control, such as natural disasters or government restrictions, we will work with you to reschedule at no additional cost. Refunds are not guaranteed under these circumstances.

Refund Timeline

We reserve the right to issue refunds within 60 days from the date of cancellation approval.

Use of Property

General Terms

• —The Client agrees to use the property responsibly and in accordance with all applicable laws and regulations.
• —The Client shall not exceed the maximum occupancy limit. Additional guests incur a surcharge of 1,900 Mexican Pesos per person, per night.
• —No pets are allowed unless explicitly agreed upon in writing by Onze Retreats.
• —Smoking is prohibited inside the property. Designated smoking areas are available.

Specific Terms

• —Vacations: Guests may use the property and facilities for relaxation and recreation.
• —Retreats: Clients must provide a schedule of planned activities and ensure compliance with property guidelines at least 14 days before the event.
• —Weddings & Events: Clients must provide a detailed event schedule at least 30 days before the event. All third-party vendors must be approved by Onze Retreats. We charge no commission or markup on your external vendors.

Liability and Damages

Responsibility for Damages

The Client is responsible for any damage they or their party cause to the property or its contents during their stay. A refundable damage deposit of 20,000 Mexican Pesos is required 7 days before arrival for vacations and weddings.

Limitation of Liability

Onze Retreats is not liable for any accidents, injuries, or illnesses that occur while on the premises. The Client is responsible for the safety and security of their personal belongings. It is recommended that valuables be stored securely in the lockable safes provided in each villa.

Check-In and Check-Out

• —Check-In: Available from 3 PM on the arrival date. Early check-in is based on availability and incurs a 20,000 MXN fee.
• —Check-Out: Must be completed by 11 AM on the departure date. All decorations and personal items must be removed by this time.

Changes to Booking Date

• —Modification: All requests for booking date modifications must be made in writing. Approval is subject to availability and may incur additional costs.
• —Deposit Retention: The initial deposit will be held 'on account' and applied to a subsequent booking within 12 months.
• —Rebooking: The new booking is subject to prevailing seasonal rates. If the rate exceeds the original, the Client is responsible for the difference.
• —Forfeiture: If the Client fails to use the deposit for a new reservation within the 12-month period, the deposit will be forfeited to Onze Retreats.

Miscellaneous

• —Entire Agreement: These Terms of Service constitute the entire agreement between the parties and supersede any prior agreements or understandings.
• —Amendments: Any amendments to this Agreement must be made in writing and signed by both parties.
• —Compliance: The Client agrees to comply with all local laws and regulations, including obtaining any necessary permits for events.
